1. Introduction
Quantum Growth LLC (“Company,” “we,” or “us”) respects Your privacy and is committed to protecting it through this Privacy Policy.
This Privacy Policy governs Your access to and use of www.janikasmit.com, including any content, functionality and services offered on or through www.janikasmit.com (the “Website”), whether as a guest or a registered user. It also applies to information collected through our coaching engagements, our member portal, our AI assistant (JanikAi), AI-assisted processing of coaching sessions, and any related communications.
When accessing the Website, the Company will learn certain information about You, both automatically and through voluntary actions You may take, during Your visit. This policy applies to information we collect on the Website and in email, text, or other electronic messages between You and the Website.
Please read the Privacy Policy carefully before You start to use the Website. By using the Website or by clicking to accept or agree to the Terms of Use when this option is made available to You, You accept and agree to be bound and abide by the Privacy Policy. If You do not want to agree to the Privacy Policy, You must not access or use the Website.
2. Children Under The Age Of 13
Our Website is not intended for children under 13 years of age, and our services are intended for adults. No one under the age of 13 may provide any information to or on the Website. We do not knowingly collect personal information from children under 13. If You are under 13, do not use or provide any information on this Website or on or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive features of this Website, or provide any information about Yourself to us, including Your name, address, telephone number, email address, or any screen name or user name You may use.
If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If You believe we might have any information from or about a child under 13, please contact us at privacy@janikasmit.com.
3. Types of Information We Collect About You
When You access the Website, the Company will learn certain information about You during Your visit.
3.1 Information You Provide To Us
The Website provides various places for users to provide information. We collect information that users provide by filling out forms on the Website, communicating with us via contact forms, responding to surveys, providing comments or other feedback, and providing information when ordering a product or service via the Website. When You book a discovery call, become a coaching client, subscribe to The Growth Circle, or contact us, You may provide:
- Name and contact information (email, phone, mailing address)
- Professional information (job title, company, industry)
- Information You share during coaching sessions or in written communications
- Payment information (processed by our payment provider; we do not store full card numbers)
- Account credentials, if You create a member account
- Voluntary information You submit through forms, surveys, or intake questionnaires
- Communications You send to us, including emails, contact form submissions, and messages exchanged through our member inbox
We use the information You provide to communicate with You, deliver the requested product and/or service, improve our overall site performance, and provide You with information about the services You have selected.
3.2 Information We Collect Through Automatic Data Collection Technology
As You navigate our Website, we use limited automatic data collection technology (such as server logs and strictly-necessary cookies) to collect certain information about Your equipment, browsing actions, and patterns. This generally includes the type of device You use, Your Internet connection, Your IP address, Your operating system, Your browser type, and Your traffic patterns through our Website.
The information we collect automatically is used for statistical purposes, to secure the Website, and to improve our Website and service offerings. To the extent that You voluntarily provide personal information to us, our systems may associate the automatically collected information with Your personal information. See Section 4 for details on cookies.
3.3 Information From Our Website AI Assistant (JanikAi)
When You interact with JanikAi, the AI chat assistant on our Website, we may collect:
- The content of Your messages to JanikAi
- Anonymized chat session metadata (timestamp, message count, session duration)
JanikAi conversations are processed by our third-party AI provider (Anthropic) to generate responses. Chat content is used only to power the conversation You are having with JanikAi. It is never used to train any public AI model, never sold, and Anthropic is contractually prohibited from training on customer content. JanikAi is not a substitute for professional coaching, therapy, or medical advice.
3.4 Information From AI-Assisted Coaching Sessions
When You become a coaching client and elect Standard posture under our Client Confidentiality Notice, we may collect and generate the following information related to Your sessions:
- Session audio, recorded with Your consent for the sole purpose of generating a transcript. Audio is deleted once a transcript exists, unless You specifically request retention.
- Session transcripts, generated by our transcription provider, stored encrypted in our database.
- AI-generated artifacts, including session recaps (drafted in Janika’s voice, reviewed and approved by Janika before release to You), thematic extractions, commitment tracking, and pre-session briefs prepared for Janika.
- Rolling client context, maintained by AI to support continuity across sessions in Your engagement.
This processing happens through Anthropic, the same AI provider behind our Website assistant (JanikAi). Your session content is used by AI only in the context of Your coaching engagement with Janika, to generate the transcripts, recaps, themes, and pre-session briefs that support that engagement. It is never used to train any public AI model, never sold, and never shared with anyone outside this engagement. Anthropic is contractually prohibited from training on customer content under our terms of service, and we do not authorize any such use by any provider.
If You elect Minimal posture, none of the above applies. Janika takes traditional notes for her own reference; no audio, transcript, or AI-generated artifact is created.
If You flag a session as Off the Record under Standard posture, that individual session is excluded from recording, transcription, and AI processing entirely.

3.5 Information From Third Parties
We may receive information about You from third parties when You:
- Authenticate via single sign-on (e.g., Google) through Clerk
- Schedule meetings with us through Calendly
- Subscribe to our email list through Kit (ConvertKit)
- Engage with our LinkedIn or other social media presence
4. Use of Cookies
Like other commercial websites, our Website uses a standard technology called “cookies” and server logs to support core functionality. Information gathered through cookies and server logs may include the date and time of visits, the pages viewed, time spent at our site, and Your IP address.
A cookie is a very small text document, often including a unique identifier. When You visit a website, that site’s computer asks Your computer for permission to store this file in a part of Your hard drive specifically designated for cookies. Each website can send its own cookie to Your browser if Your browser’s preferences allow it, but (to protect Your privacy) Your browser only permits a website to access the cookies it has already sent to You, not the cookies sent to You by other sites.
We currently use only strictly-necessary and functional cookies — for example, to maintain Your session and login state (through our authentication provider, Clerk) and to enable embedded functionality such as scheduling (Calendly). We do not currently use analytics cookies, marketing or advertising cookies, social media tracking pixels, or third-party advertising networks, and we do not use cookies for cross-site advertising tracking. Because the cookies we use are strictly necessary to provide the services You request, they do not require opt-in consent.
You can control or disable cookies through Your browser settings, though disabling strictly-necessary cookies may prevent parts of the Website (such as the member portal) from working. If we introduce analytics or marketing technologies in the future, we will update this policy and provide an appropriate consent mechanism at that time.
5. Email Information & Policies
If You choose to correspond with us through email, we may retain the content of Your email messages, Your email address, and our responses. We provide the same protections for these electronic communications that we employ to maintain information received online, by mail, and by telephone. This also applies when You register for our Website, sign up through any of our forms using Your email address, or make a purchase on this site.
We are committed to keeping Your email address confidential. We do not sell, rent, or lease our subscription lists to third parties and will not disclose Your email address to any third parties except as described in the Disclosure of Your Information section.
We send marketing or newsletter communications only where You have signed up to receive them. In compliance with the CAN-SPAM Act, all emails sent from our organization will clearly state who the email is from and provide clear information for contacting the sender. All marketing email messages will also contain concise instructions for removing Yourself from our mailing list so that You receive no further marketing communication from us. You may unsubscribe at any time by following the unsubscribe link in any such email. If You ever have trouble unsubscribing, You can email privacy@janikasmit.com requesting to unsubscribe from future emails.
6. How We Use the Information That You Provide to Us
We use the information we collect to:
- Deliver coaching, facilitation, and membership services You have engaged us for
- Schedule and conduct coaching sessions and discovery calls
- Generate AI-assisted session recaps, themes, and pre-session briefs for clients on Standard posture, in support of the coaching engagement
- Process payments and manage subscriptions
- Send transactional communications (booking confirmations, account notices, session recaps after Janika’s approval)
- Send marketing communications (only with Your consent; You can unsubscribe at any time)
- Provide customer support and respond to inquiries
- Operate, secure, and improve our Website and services
- Carry out any contract between You and the Company
- Comply with legal obligations (tax records, contracts, regulatory requests)
- Detect, prevent, and respond to fraud, abuse, or security incidents
We do not sell Your personal information.
7. Disclosure of Your Information
As a general rule, we do not sell, rent, lease, or otherwise transfer any information collected from You. We share information only as necessary to deliver our services and as described below.
7.1 Service Providers
We share information with trusted third-party providers who help us operate our business:
- Vercel (website hosting)
- Supabase (database and member portal infrastructure)
- Clerk (authentication and account management)
- Stripe (payment processing)
- Calendly (scheduling)
- Anthropic (website AI assistant and AI-assisted processing of coaching sessions for clients on Standard posture; contractually prohibited from training on customer content)
- Otter (transcription of session audio for clients on Standard posture; bound by confidentiality and no-training terms)
- Kit / ConvertKit (email marketing)
- Formspree (contact form processing)
Each provider is bound by contractual obligations to protect Your information and use it only for the purposes we have engaged them for.
7.2 Legal Compliance
We may disclose information when legally compelled to do so — in other words, when we, in good faith, believe that the law requires it, or for the protection of our legal rights, or when compelled by a court or other governmental entity. We may also disclose Your personal information to a third party, including a lawyer, our payment processor, or a collection agency, to enforce our Terms of Use or any other agreement between You and the Company.
7.3 Business Transfers
We may provide Your information to any successor in interest in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets and/or business. We will notify You before Your information becomes subject to a different privacy policy.
7.4 With Your Consent
We may share information for other purposes with Your explicit consent. This includes the use of identifiable client stories in marketing, speaking, writing, or books, which require Your written permission for each use as described in our Client Confidentiality Notice.
We do not sell, rent, or trade Your personal information to third parties for their marketing purposes.
8. Coaching Confidentiality
The content of Your coaching engagement, including session notes, transcripts, AI-generated recaps, themes, written exercises, and the substance of conversations with Janika, is held to a higher standard of confidentiality than this Privacy Policy alone describes. See our separate Client Confidentiality Notice for the full terms governing our coaching relationship, including the choice of AI posture (Standard, Minimal, or Off the Record per session) and the framework for any public reference to Your specific story.
In short: what You share in coaching stays in coaching, with narrow exceptions for legal compliance, safety, and supervision (when applicable). AI-generated artifacts produced from Your sessions are subject to the same confidentiality commitments as Your spoken words.
9. Data Retention
We retain different types of information for different periods, based on operational need, legal requirement, and the principle of keeping data only as long as necessary.

If You request deletion of Your information, we will honor that request within 30 days, subject to the legal retention obligations described above. See Section 11.
10. Your Rights
Depending on where You live, You may have the following rights with respect to Your personal information:
- Right to access: request a copy of the information we hold about You
- Right to correction: request that inaccurate information be corrected
- Right to deletion: request that Your information be deleted (subject to retention obligations described above), including the right to delete AI-generated session artifacts (recaps, themes) independently from other records
- Right to portability: request Your information in a machine-readable format
- Right to object: object to certain processing, including direct marketing
- Right to restrict processing: in certain circumstances
- Right to withdraw consent: where processing is based on consent, You may withdraw it at any time without affecting the lawfulness of processing that occurred before withdrawal
- Right to change AI posture: as a coaching client, You may switch between Standard and Minimal AI posture at any time during our engagement, or flag any individual session as Off the Record. See the Client Confidentiality Notice for details.
- Right to complain: You have the right to complain to a supervisory authority with jurisdiction over data processing and protection issues.
We require only the information that is reasonably required to enter into a contract with You. We will not require You to consent to any unnecessary processing as a condition of entering into a contract with us.
For California residents (CCPA / CPRA)
You have the right to know what personal information we collect, the right to delete personal information, the right to correct inaccurate information, the right to opt out of the sale or sharing of personal information (we do not sell or share for cross-context advertising), and the right not to be discriminated against for exercising these rights.
For European Economic Area, UK, and Switzerland residents (GDPR)
You have all the rights listed above, plus the right to lodge a complaint with Your local data protection authority. Our legal bases for processing are: performance of contract (delivering coaching services, including AI-assisted session processing for Standard posture clients), legitimate interests (operating and securing our business), consent (marketing communications, AI posture choice, identifiable storytelling permissions), and legal obligation (tax and regulatory compliance).
To exercise any of these rights, contact us at privacy@janikasmit.com or use the deletion request mechanism in Your member account (see Section 11).
11. Data Deletion Requests
You may request deletion of Your account and associated personal information at any time.
For members with active accounts:Use the “Request Account Deletion” option in Your account settings. You will receive a confirmation email; once confirmed, we will process the deletion within 30 days.
For non-members or anyone else: Email privacy@janikasmit.comwith the subject line “Data Deletion Request.” We will verify Your identity and process the request within 30 days.
Granular deletion options for coaching clients: You may request deletion of specific categories of information without closing Your account, including:
- All AI-generated session artifacts (recaps, themes, commitments, rolling context) while retaining Your account, scheduled sessions, and assigned resources
- Specific session recaps, by date or session
- Session transcripts, while retaining the recap
- All session-related material, while retaining Your account
What gets deleted in a full account deletion:
- Member account and profile
- Coaching session notes, transcripts, and AI-generated recaps and themes
- Pre-session briefs and rolling client context
- Member inbox messages
- AI chat history associated with Your account
- Marketing email subscription
- Communications and contact information
What we retain (and why):
- Financial records, in anonymized form, for 7 years (IRS requirement)
- Engagement contracts, in anonymized form, for 6 years (NJ statute of limitations)
- Backup copies of deleted data, until backups expire (within 30 days of deletion)
You will receive confirmation when the deletion is complete.
Note on active subscriptions: If You have an active Growth Circle or coaching subscription, You will need to cancel the subscription before requesting account deletion. Otherwise, we cannot complete the deletion.
12. How We Protect Your Information and Secure Information Transmissions
We employ commercially reasonable methods to ensure the security of the information You provide and the information we collect automatically. This includes:
- Encryption of data in transit (TLS/HTTPS) and at rest
- Authentication and access controls (Clerk)
- Database row-level security on all member data (Supabase)
- Multi-factor authentication available for member accounts
- Regular security audits and dependency scanning
- Limited access to client data by authorized personnel only
- Contractual prohibition on use of session content to train any public AI model
- Working only with reputable third-party vendors
Email is not recognized as a secure medium of communication. For this reason, we request that You do not send private information to us by email. However, doing so is allowed, but at Your own risk. Credit card and other sensitive payment information is handled by our payment processor and is never transmitted to us via email.
No system is perfectly secure. If we become aware of a security incident affecting Your information, we will notify You in accordance with applicable law.
13. International Data Transfers
Our service providers are located primarily in the United States. If You access our services from outside the United States, Your information will be transferred to, stored, and processed in the United States.
Where required by law, we use Standard Contractual Clauses or other approved transfer mechanisms to provide adequate protection for personal information transferred internationally.
14. Third-Party Links
Our Website may contain links to third-party websites (LinkedIn, Calendly, etc.). This Privacy Policy does not apply to those sites. We encourage You to read their privacy policies before sharing information with them.
15. “Do Not Track” Requests
Certain internet browsers allow users to send “Do Not Track” requests to sites they visit. Unfortunately, there is no industry or legal standard (or easy technological solution) to handle these responses. Thus, we do not currently honor Do Not Track signals.
16. Changes to This Policy
Our policy is to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users’ personal information — including changes to AI processing or AI vendor relationships — we will notify You by email to the email address specified in Your account and/or through a notice on the Website home page. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for You and for periodically visiting our Website and this Privacy Policy to check for any changes.
